This policy applies to Heart & Soul Mortgages, operated by Tiphereth Straker, Mortgage Agent Level 2 (licence M21004493), and to this website. All mortgages are arranged through BRX Mortgage Inc., brokerage licence #13463. As a licensed mortgage agent, I handle your information in line with BRX Mortgage Inc.'s privacy practices and applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

What information I collect

I only collect what I need to help you. Depending on how you interact with me, that may include:

How I collect it

I collect information directly from you: through this website's forms and booking page, by email, phone, or text, and during our conversations. I collect financial information only when you engage me to help with a mortgage.

Why I collect it and how I use it

• To provide mortgage advice and arrange financing on your behalf through BRX Mortgage Inc. and its lending partners.
• To send you confirmations, reminders, and updates about your consultation and application.
• To send helpful tips, updates, and offers, but only if you have given consent, which you can withdraw at any time.
• To meet the legal, regulatory, and record-keeping obligations that apply to licensed mortgage agents.

Your consent

I collect, use, and share your personal information with your consent. For electronic marketing messages, I rely on your express consent as required by CASL, and every marketing message includes a simple way to unsubscribe. You can withdraw your consent at any time by contacting me, though some information may still need to be kept to meet legal and regulatory requirements or to complete work already underway.

Who I share it with

I never sell your personal information. I share it only as needed to serve you, including with:

• BRX Mortgage Inc., the brokerage I am licensed under.
• Lenders and mortgage default insurers, in order to arrange and process your mortgage.
• Trusted service providers who help me run my business, such as my client-relationship and booking platform and my website host. They receive only the information needed to do their job.
• Other professionals you ask me to work with, such as your accountant, lawyer, or realtor.
• Authorities or regulators where required by law.

Some service providers may store information on servers located outside of Canada, including in the United States, where your information may be subject to the laws of those jurisdictions.

How I protect it

I take reasonable steps to safeguard your personal information against loss, theft, and unauthorized access, using practical, organizational, and technological measures. No method of transmission or storage is ever completely secure, but I treat your information with the care it deserves.

How long I keep it

I keep your personal information only as long as needed for the purposes described here, or as required by the laws and regulations that apply to mortgage agents. When it is no longer needed, it is securely disposed of.
